We advise employers in respect of the steps to take to manage employees who have a record of intermittent absence or are absent on a period of long term sickness absence. Such procedure can be affected in circumstances where the employee may be considered a disabled person within the meaning of the Equality Act 2010 and there may, for example, be a need to request a GP or Occupational Health report.

Absence Management should be dealt with appropriately and regular contact should be maintained with the employee where the ultimate conclusion can be dismissal for ill-health capability, in order to show that the employer has acted fairly and within the range of reasonable responses.
We can also prepare sickness absence management procedures for inclusion in a staff handbook.
We advise employees who are absent from work on whether the treatment of them whilst on sickness absence is fair and what to expect.
