Cookie Update – New ICO Guidance Issued
Following on from our recent article ("Have you got acookie monster lurking in the wings?"), the InformationCommissioner`s Office has just released its initial Guidance on theoperation of the new law relating to website cookies. In short, ifthe operator of a website wishes to place a cookie on a user`scomputer it must first obtain that user`s consent. It is not yetclear how this can be achieved without subjecting the user to apotentially cumbersome tick-box process, although it is hoped thatindustry-led solutions will emerge over the coming weeks andmonths.
In the meantime the ICO has advised that each organisationwith a website should:
1. check what type of cookies and similar technologies ituses and how it uses them;
2. assess how intrusive that use of cookies is;and
3. decide what solutions to obtain consent will be best inthe circumstances.
